Terms of Use
The Cakebook is a directory, not a bakery, booking agent, marketplace, payment service, insurer or guarantor. Visitors and makers deal directly with one another. Nothing here removes rights that South African law does not allow anyone to exclude.
1. Using The Cakebook
By browsing, saving, contacting a maker or submitting a page, you agree to these terms. If you do not agree, do not use the service. You must use The Cakebook lawfully and may not scrape contact details, impersonate another person, interfere with the service, submit false reports or use the service for fraud, harassment or unlawful discrimination.
2. Directory only
The Cakebook introduces visitors to independent makers. The Cakebook and Secret Sugar Academy are not a party to enquiries, quotations, orders, bookings, payments, collections, deliveries, cancellations or disputes between a visitor and a maker. Money must never be paid to The Cakebook for a maker's order.
A listing, Academy membership, review or honour is not a warranty or guarantee of identity, licensing, availability, price, quality, food safety, allergen suitability, conduct or fitness for a particular purpose. Visitors must make their own checks before ordering or paying.
3. Maker promises
A person submitting or managing a listing confirms that they are at least 18, or that a parent or legal guardian accepts these terms and responsibility on their behalf. The maker confirms that:
- the listing is truthful, current and not misleading;
- they are entitled to use the business name, photographs, logos and other material supplied;
- photographs show work they made and are not AI-generated or materially altered with generative AI;
- their trading, advertising, food preparation, allergen information, labelling, pricing and fulfilment comply with applicable law;
- they will not infringe privacy, intellectual-property or other rights; and
- they will deal honestly and safely with visitors.
The maker grants Margaretha Joubert, trading as Secret Sugar Academy a non-exclusive, worldwide, royalty-free licence to host, resize, reproduce and display submitted material for operating, promoting and archiving The Cakebook. The maker keeps ownership of their material and may request removal, subject to reasonable record-retention duties.
4. Review and removal
Publication is discretionary. We may request evidence, refuse, edit for formatting, hide, suspend or permanently remove content or accounts that appear unsafe, unlawful, misleading, infringing, AI-generated, abusive or inconsistent with these terms. We may preserve relevant records and cooperate with lawful authorities. We do not promise to pre-screen every item or continuously monitor every listing.
5. Safe transactions
Confirm the maker's identity and contact details, obtain a written quotation, discuss allergens and food handling, keep records, and use a payment method that offers appropriate protection. Do not send passwords, one-time codes or unnecessary identity documents. Report suspicious conduct promptly.
6. Availability and changes
The service may change, pause or end, and listings may become outdated. We do not promise uninterrupted or error-free operation. These terms may be updated; a maker will be asked to accept a new version before a later submission when the changes materially affect maker obligations.
7. Liability
To the fullest extent permitted by South African law, Margaretha Joubert, trading as Secret Sugar Academy is not liable for loss arising from a transaction or interaction between users, reliance on a listing, third-party conduct, unavailable service, or unauthorised use outside our reasonable control. This clause does not exclude liability or consumer rights that cannot lawfully be excluded, including liability arising from gross negligence where exclusion is prohibited.
A maker is responsible for claims caused by their unlawful content, infringement, misrepresentation, products, services or conduct, and agrees to reimburse reasonable loss and legal cost suffered by the operator as a direct result, to the extent permitted by law.
8. Law and contact
South African law applies. South African courts have jurisdiction, subject to any forum or remedy a consumer is entitled to use. Questions, takedown notices and complaints may be sent to privacy@secretsugaracademy.co.za.
